Abstract
Bu tezde, kamu görevlilerinin (memurların), haklarını korumak ve geliştirmek için oluşturdukları sendika örgütlenmeleri ve 4688 Sayılı Kamu Görevlileri Sendika Yasası çerçevesinde toplu görüşme yöntemi incelenmiştir.Sendika hareketi, sanayi devrimiyle beraber Avrupa'da başlamış ve daha sonra dünyaya yayılmıştır. İşçi sınıfıyla başlayan bu hareket, kamu görevlilerine de örnek olmuştur. Bu çalışmamızda memur sendikacılığın Türkiye'de gelişimi ve bugünkü durumu, uluslararası örgütler ve uluslararası sözleşmeler üzerinde durulmuştur. Ayrıca kamu görevlileri sendikalarının, toplu görüşme yöntemi ile ilgili düşünceleri araştırılmıştır.Çalışmamız, literatür taraması, konuyla ilgili kitap, makale, web siteleri, vb, kaynakların taranması şeklinde olmuştur. Konuyla ilgili olarak, kamu görevlileri sendikalarıyla bir anket-mülakat çalışması yapılmıştır.Türkiye'de Sendikacılığın, dernekçiliği çok aşamadığı, ideolojik görüşler etrafında örgütlendiği, memurların haklarını koruma ve geliştirmede çok başarılı bir performans sergileyemedikleri görülmüştür. Ayrıca 4688 sayılı yasa da sendikalara çok fazla imkân vermemektedir.Sendikaların büyük bir çoğunluğunun hedefinin grevli toplu sözleşme olduğu, 4688 sayılı yasaya göre yapılan toplu görüşme yönteminden, sendikaların hiç memnun olmadığı görülmüştür.
In this thesis, public servant union, which has been constituted in order to protect and to develop the rights of public servants, and the method of collective negotiations, which is realized according to the Public Servant Union Law no 4688, were researched.Union movement started in Europe by industrial revolution and the it was spread out to whole world. This movement, which was started by working class, set the pace for public servant. In this study, unionism development in Turkey and its future, international organizations and international agreements were taken into consideration. However the ideas of public servant unions related to the method of collective negotiations were investigated.Our study was realized by way of researching the literature, the books, the articles, web sites regarding the subject. A questionnaire regarding to the subject with public servant union was realized.It has been determined that public servant unionism in Turkey has not been able to exceed activities peculiar to association and they have been organized around ideological views and they are below strength to protect and develop the rights of civil servant. Besides all these, the law no 4688 does not give enough possibility to the public servant unions.The main goal of the most public servant unions is the collective negotiations and they are not all gratified from the method of the collective negotiations organized according to the law no 4688.
