Üye Devletlerin Anlaşmalar Önünde Eşitliği Prensibinin Bir İfadesi Olarak Birlik Hukukunun Uygulanma Önceliği

Abstract

B organlarının yetki aşımlarının anayasa mahkeme- leri tarafından denetimi (ultra vires denetim) anlaşmalar önünde üye devletlerin eşitliği prensibi muvacehesinde Birlik Hukuku’nun öncelikli uygulanması prensibinin tartışılmasına yol açmıştır. Birlik Hukuku’nun öncelikli uygulanması Birlik Hukuku- Ulusal Hukuk ça- tışmasında COSTA/ENEL kararından itibaren bir dogma olarak kabul edilmekte ve doğrudan uygulanma özelliğine sahip Birlik Hukuku normlarına ulusal hukuka nazaran öncelik verilmektedir. Ultra vi- res denetim üye devletlerin anayasalarında öngörülen sınırlara isti- naden AB’ye devrettikleri egemenlik yetkilerinin sınırlarının AB or- ganları tarafından aşılması halinde ulusal mahkemelere saklı tutulan bir denetimdir. Birlik Hukuku’nun doğrudan uygulanma önceliği ile ultra vires yetki denetiminin arasındaki farkı ortaya koyan bu tespit üye devletlerin anlaşmalar önünde eşitliği prensibi muvacehesinde Birlik Hukuku’nun uygulanma önceliğini engellenemeyeceği gerek- çesi ile anayasa mahkemelerinin ultra vires yetki denetimine yapılan itirazın dogmatik yanlışlığını ortaya koymaktadır. Makalede Birlik Hukuku’nun önceliği, anlaşmalar önünde üye devletlerin eşitliği prensibi ve ultra vires yetki kullanımı bağlamında yapılan değerlen- dirmelere ve tartışmalara ışık tutulmaktadır.

The review of the excesses of powers of the EU organs by the constitutional courts (ultra vires control) has led to the discussion of the principle of priority application of Union Law in view of the principle of equality of member states before agree- ments. Priority implementation of Union Law has been accepted as a dogma in the Union Law - National Law conflict since the COSTA/ ENEL decision, and Union Law norms that are directly applicable are given priority over national law. Ultra vires control is an inspection reserved for national courts in case the EU bodies exceed the limits of the sovereign powers that the member states have transferred to the EU, based on the limits stipulated in their constitutions. This determination, which reveals the difference between the priority of direct implementation of Union Law and ultra vires jurisdiction, reveals the dogmatic fallacy of the objection to the ultra vires ju- risdiction of constitutional courts on the grounds that the prior- ity of implementation of Union Law cannot be prevented in view of the principle of equality of member states before agreements. The article sheds light on the evaluations and discussions made in the context of the priority of Union Law, the principle of equality of member states before agreements and the use of ultra vires power.
