Abstract
Federal Almanya’da diğer uluslararası anlaşmalar gibi AİHK de iç hukukta kanun hiyerarşisi ile geçerli olmaktadır. Alman anayasasının ılımlı dualist karakteri nedeniyle AİHK ile olan ilişkisinde bu bağlamda kimi sorunlar ortaya çıksa da bu sorunların anayasal bir prensip olan uluslararası hukuka dostça yaklaşım prensibine istinaden çözüme ulaştırıldığı görülmektedir. Makalede uluslararası hukuka dostça yaklaşım prensibinin lex posterior kuralı, anayasal kimlik, elverişlilik kriteri, margin of appreciation doktrini sınırlamaları ışığında bu sorunların bir taraftan Federal Alman Anayasa Mahkemesinin anayasanın kurumsal yapısındaki yerinin ve fonksiyonunun, diğer taraftan AİHM’nin ulusal hukuk düzeninde sahip olduğu fonksiyonun ve otoritenin dikkate alınarak nasıl çözüme ulaştırıldığı değerlendirilmektedir.
In the Federal Republic of Germany, like other international agreements, the ECHR is valid in domestic law through a hierarchy of laws. Although some problems have arisen in this context in its relationship with the ECHR due to the moderate dualist character of the German constitution, it seems that these problems have been resolved based on the principle of friendly approach to international law, which is a constitutional principle. In the article, in the light of the limitations of the principle of friendly approach to international law, the lex posterior rule, constitutional identity, the criterion of convenience, the margin of appreciation doctrine, these problems are examined, on the one hand, the place and function of the Federal German Constitutional Court in the institutional structure of the constitution, and on the other hand, the function and authority of the ECHR in the national legal order.
