| dc.description | ABSTRACT: : Ownership of property allows rightful owners to use, to benefit and to dispose of the fixed property and movable goods. That kind of property is divided to two. One is, the only property itself, the other one is common property which is also divivded to two as joint ownership, and co-ownership Joint ownership takes place in Article 688 of Civil Law as, “More than a person has the property totally without divided it to pieces in some significant parts.” And the rest of the article regulates the rights and obligations of joint owners. The subject of the essay is related with joint ownership. We will discuss the joint ownerships between conjoints. While discussing the subject, we will give information about the differences of legal pre-emption right and legal emption right. | |
| dc.description.abstract | Taşınır ya da taşınmaz bir eşya üzerinde, hak sahibine kullanma, yararlanma ve tasarruf etme yetkisi veren, mülkiyet hakkı, hak sahibinin sayısına göre tek başına mülkiyet ve birlikte mülkiyet olmak üzere ikiye ayrılırken; birlikte mülkiyet de kendi içinde, elbirliği halinde mülkiyet ve paylı mülkiyet olmak üzere ikiye ayrılmaktadır. Paylı mülkiyet, TMK md.688’de “birden çok kimsenin, maddi olarak bölünmüş olmayan bir şeyin tamamına belirli paylarla malik olduğunu” şeklinde düzenlenmiş olup, devamı maddelerde, hak sa hibinin hak ve borçları düzenlenmiştir. Konumuz ise, eşler arasında paylı mülkiyet olup; yasal önalım hakkından farklı olan yasal alım hakkı düzenlemesine yol açan bu kavram ile, eşlerin bir eşya üzerindeki paylı mülkiyetlerinin koşulları belirlenmekte, hakkın kullanılma sınırlarının çizilmektedir. | |
