Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Borçlunun borcu sebebiyle cebri icra organları tarafından mal, hak ve alacakları haczedilir. Bu haciz işlemini, sınırlandıran birtakım kurallar söz konusudur. Bu kurallar 'haczedilmezlik kuralları' olarak adlandırmaktadır. Haczedilmezlik kuralları maddi hukuk, özel kanunlar ve icra ve iflâs hukukundan kaynaklanmaktadır. İcra ve iflâs hukukundan kaynaklanan haczedilmezlik kuralları, kısmen ve tamamen olmak üzere iki ayrı görünüme sahiptir. 'İcra ve İflâs Kanunu Kapsamında Tamamen Haczedilmezlik' adlı bu çalışmanın konusunu İcra ve İflâs Kanununun 82. maddesinde düzenlenen tamamen haczedilmezlik kuralları oluşturmaktadır. Bu çalışma ile tamamen haczedilmezlik kurallarının amacı, kapsamı ve niteliği ortaya konulmuştur. Çalışmada öncelikle haczedilmezlik kuralları başlığı altında yapılan birtakım sınıflandırmalara yer verilmiştir. Sonrasında ise, bu sınıflandırmanın önemli bir boyutunu oluşturan 'tamamen haczedilmezlik kuralları' tek tek işlenmiştir. Tamamen haczedilmezlik kuralları işlenirken doktrin ve Yargıtay kararlarına temas edilerek, tartışmalı ve belirsiz olan hususlar açıklığa kavuşturulmaya çalışılmıştır. Due to the debt of the debtor, his property, rights and receivables are seized by the enforcement organs. There are some rules that limit this foreclosure process. These rules are called 'non-seizure rules'. The rules of non-seizure arise from substantive law, special laws, and Execution and Bankruptcy Law. The rules of non-seizure arising from the Enforcement and Bankruptcy Law have two different appearances, partially and completely. The subject of this study titled 'Totally Unseizable in Enforcement and Bankruptcy Law' is the rules of total non-seizure regulated in Article 82 of the Execution and Bankruptcy Law. With this study, the purpose, scope and nature of the rules of non-seizure have been revealed. In the study, first of all, some classifications made under the umbrella of non-seizure rules are included. Afterwards, the 'total non-seizure rules', which constitute an important dimension of this classification, are handled one by one. While the completely non-seizure rules were being processed, the controversial and ambiguous issues were clarified by referring to the Doctrine and the Supreme Court decisions.
