Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Niteliği hukuk devleti olan Türkiye Cumhuriyeti'nde, idarenin tüm iş ve eylemleri yargısal denetime tabidir. Bununla birlikte, İdarenin yargı dışı denetim yolları ile denetlenmesi de mümkündür. Hatta, yargı dışı denetim yolları, yargısal denetime nazaran, daha hızlı ve masrafsız olabilmektedir. İdarenin yargı dışı denetim yollarından biri de zorunlu idarî itiraz müessesidir. Zorunlu idarî itiraz başvuruları, sui generis bir başvuru türü olup, hak arama özgürlüğünün bir vasıtası olduğu gibi, hak arama özgürlüğünün en etkili güvencesi olan mahkemeye erişim hakkını da kısıtlar niteliktedir. Bu bağlamda, zorunlu idarî itiraz başvurularının mahkemeye erişim hakkının özünü ortadan kaldırmamak üzere, yasayla düzenlenmesi gerekmektedir. 4734 Sayılı Kamu İhale Kanunu'nda İdarenin ihale sürecinde yaptığı iş veya eylemlere karşı öngörülen ihalelere yönelik başvurular da (İdareye şikayet ve Kamu İhale Kurumu'na itirazen şikayet başvuruları) yasayla düzenlenmiş zorunlu idarî itiraz başvurularından biridir. Bu tez çalışmasında, 4734 Sayılı Kamu İhale Kanunu'na göre yürütülen ihale sürecinde, İdarenin hukuka aykırı tesis ettiği işlemler üzerinden İdarenin zorunlu idarî itiraz başvuruları ve zorunlu idarî itiraz başvurusu sonrasında yargı yolunda denetlenmesi incelenmiştir.
In the Republic of Turkey, which is a state of law, all acts and actions of the administration are subject to judicial review. However, it is also possible to monitör the administration through non-judicial means of review may be faster nd less costly than judicial review. One of the non-judicial menas of review of the administration is the institution of compulsory asministrative appeal. Compulsory administrative appeals are a sui generis type of application and are a means of the freedom to seek rights, as well as the most effective guarantee of the freedom to seek rights. It also restricts the right of access to a court. In this context, mandatory administrative objection applictions should be regulated by law, so as not to abrogate the essence of the right of access to a court. Law No. 4734 on Public Procurement also provides that the applications against the acts or actions of the procurement process (complaints to the contracting authority and appeals to the Public Procurement Aurhority) are among the mandatory administrative appeals regulated by law. In this thesis, compulsory administrative appeals against the unlawful actions of the Administration in the tender process carried out in accordance with the Public Procurement Law No. 4734 and the judicial review made after the compulsory administrative appeals are discussed.
