Law
(2003)
Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

17/10/2019 tarih ve 7188 Sayılı Kanun ile Türk Hukuk Sistemine 'Bazı Suçlara İlişkin Muhakeme' başlığı altında yeni bir sistem olarak getirilen 'Seri Yargılama Usulü' mahkemelerin iş yükünün belli önem derecesinin altında kalan suçlar yönünden azaltılarak yargılamalara hız kazandırılmasını amaçlayan özel bir yargılama usulüdür. Seri yargılama usulünde savcı, soruşturma evresi sonunda kamu davası açmak yerine kanunda öngörülen belli suçlar bakımından tespit edeceği temel cezadan kanun gereği yarı oranda indirim yapmak suretiyle bir yaptırım belirleyerek hazırlayacağı talep yazısını onaylanmak üzere mahkemeye sunmaktadır. Seri yargılama usulünün savcıya tanıdığı geniş yetkiler neticesinde mahkemeler usul kapsamında kalan suçlar bakımından neredeyse pasif duruma getirilmiş, yetkileri yaptırımı onaylama ya da belli şartlar altında talep yazısını geri gönderme veya talebin reddiyle sınırlandırılmıştır. Seri yargılama usulü, genel muhakeme kurallarından sapan yapısıyla birlikte ceza hukukunun temel ilkelerinin ihlal edildiği tartışmalarını da beraberinde getirmiştir.
The 'Accelerated Trial Procedure', which was introduced as a new system under the heading 'Trial Regarding Certain Crimes' with the Law No. 7188 of 17/10/2019, included in Turkish Law in terms of crimes below a certain level of importance. It is a special procedure that aims to accelerate the trial by reducing the burden. In the 'Accelerated Trial Procedure', the Public Prosecutor submits a letter of request to the court for approval, instead of filing a public case at the end of the investigation phase, to be approved by the law, by making a reduction from the basic penalty, which he himself will determine the sanction for certain crimes. With this regulation, which gives the Public Prosecutor the authority to impose a sentence as if it were a court, the courts were made almost passive in the crimes within the scope of the procedure, their authority was limited to approve the sanction or to send the request letter back or the rejection of the request under certain conditions. The 'Accelerated Trial Procedure', along with its structure deviating from the general reasoning rules, brought about the arguments that the basic principles of the criminal law were violated.
