Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Toplumsal yaşamın devamı amacıyla gerçekleştirilen suçlulukla mücadelenin, en önemli alanlarının başında hiç şüphesiz çocuk suçluluğu ile mücadele gelmektedir. Geleceğimizin teminatı çocuklarımızın suç ile ilişkileri yetişkin suçluluğundan farklı ve çok yönlü olarak ele alınmalıdır. Kusur yeteneği olmayan çocukların suçluluğunda, suçun önlenmesi ve bu suretle gerek çocukların gerekse toplumsal düzenin korunması amacıyla 5237 sayılı Türk Ceza Kanunu ve 5395 sayılı Çocuk Koruma Kanunu kapsamında kabul edilen çocuklara özgü güvenlik tedbirleri çalışmamızın konusunu oluşturmaktadır. Bu anlamda çocuk kavramı ve çocuk suçluluğunun nedenleri ile ceza sorumluluğu olmayan çocuklar bakımından kabul edilen çocuklara özgü güvenlik tedbirlerinin niteliği, çeşitleri, amacı, uygulanma şartları, uygulama usulü ve infazına ilişkin Türk hukukunda yer alan düzenlemeler incelenerek, güvenlik tedbirlerinin çocuk suçluluğunu önlemede ve toplumsal düzenin korunmasında etkili olabilmesi amacıyla tespit edilen hususlar ve öneriler çalışmamızda ele alınmaktadır. One of the most important area of the fight against criminality, which is carried out for the continuation of social life, is undoubtedly the fight against juvenile delinquency. Our children's relationship with crime should be approached differently from adult criminality and in a multifaceted way, as they are the guarantee of our future. The subject of our study is the security measures for juveniles recognized under the Turkish Penal Code No. 5237 and the Child Protection Law No. 5395 in order to prevent the crime and thus to protect both the children and the social order in the delinquency of non-culpable juveniles. In this sense, the concept of child and the reasons for juvenile delinquency and the nature, types, purpose, implementation conditions, implementation procedure and execution of security measures for juveniles accepted as those without criminal responsibility are examining by the regulations in Turkish law, identified issues and recommendations in order for security measures to be effective to prevent juvenile delinquency and maintain social order are discussed in our study.
