Abstract
Bu çalışmada, Türkiye'nin Avrupa Birliği'ne adaylığının kabul edildiğiAralık 1999 tarihinden itibaren, 2006 yılı sonuna kadar ki süreçte kollukmevzuatı ve uygulamalarında yaşanan değişim incelenmiştir. Bu kapsamdaöncelikle teorik bilgilere değinilmiş ayrıca uygulamanın öne çıkardığı örneklerde ihmal edilmemiştir. Bu değişim genel hatları ile incelenmiş olup ayrıntıdankaçınılmıştır. Zira bazı konular ( örnek: arama, gözaltına alma) başlı başınabir tez çalışmasının konusunu oluşturacak derinliğe sahiptir.Geride bıraktığımız dönemde, AB' ye üyelik sürecinde siyasi kriterlerve insan hakları her zaman ön planda olmuştur. Kolluk bu iki kavramın damerkezindedir. şkence ve kötü muameleden mahkûm olmuş, hizmetüretemeyen, Avrupalı meslektaşları ile eşgüdüm içinde çalışamayan birkolluk teşkilatı ile AB'ye girmemiz bir hayaldir. Çalışma konusunun ?AB üyeliksürecinin kolluğa etkisi? olarak tespit edilmesinin en başta gelen nedeni:Kolluk uygulamaları ile AB üyeliğimizin birbiriyle yakın ilişkili olmasındandır.Bu konunun seçiminde gerçekleşmesi umulan pratik yarar ise: kollukpersonelinin bilgi ihtiyacını karşılayacak bir kaynak oluşturmaktır.Kolluk yetkilerinin kullanılması, zorunlu olarak birçok temel hak veözgürlüğün sınırlandırılması sonucunu doğurmaktadır. Bu nedenle kollukpersonelinin, kolluk yetkilerinin yasal dayanaklarını ve sınırlarını çok iyibilmesi gerekir. AB süreci ile hukuk bilgisine sahip Cumhuriyet savcılarınınkolluğun önüne geçmesi, temel hak ve hürriyetler açısından son dereceolumlu bir gelişmedir.Demokrasi, hukukun üstünlüğü ve insan haklarına saygı prensiplerininuygulandığı bir toplumda, devlet, insanların huzur ve mutluluğu için bir hizmetaracı ve kolluk da emniyet ve asayiş üreten bir birimdir. Böyle bir toplumdakolluğun insan haklarına saygı göstermesi, kendini hukuk kuralları ile bağlıgörmesi, vücut bulduğu devletinin meşruiyetini ve güvenini arttırır.
In this study, the change in Security force legislation andapplications have been inspected within the period starting from December1999 when the candidacy of Turkey is accepted by The European Union, tillthe end of 2006. In this scope first theoretical information information ismentioned and also basic the examples appearing with the application arenot neglected. This change is investigated in general lines and details areavoided. Because some of the matters are detailed enough to be able to be asubject of thesis (example: search, to put under surveillance).In the past period, political criteria and human rights have always beenthe most important things during The EU membership period. The securityforce is at the center of both of these concepts. It is a dream to be a memberof EU with a Security force that has been sentenced because of badtreatment, that can not produce services and that can not work incoordination with The European co-workers. The basic reason ofdetermining the study topic as ?The effect of EU membership period onSecurity force? is: security force applications and our EU membership isrelated closely to eachother. The practical benefit expected to be realized inchoosing this subject is: to create a source to respond to the informationnecessity of the police force personnel.Using the police force authorities creates the result of the limitation ofmany basic rights and freedoms in an obligatory way. For this reason thesecurity force personnel must know the limits and legal basis of theirauthorities very well. It is a very positive development for basic rights andfreedoms for public prosecutors with legal information related to EU period totake place before the police force.The State is a service tool for the peace and happiness of people andthe security force is a unit which creates security and safety in a societywhere the principles of democracy, the superiority of justice and respect forhuman rights are applied. When the security respects to the human rightsand see itself dependent upon legal rules in such a socity, this will increasethe legal condition and trust of the state in which the security force takesplace.
