Abstract
Sigorta hukuku açısından sigorta şirketi, bir hasar ya da kayıp ile ilgili olarak sigortalıya bir tazminat öder, bu oranda sigortalının yerine geçer ve sigortalıya ait olan üçüncü kişilere karşı dava hakkına, sigorta şirketi sahip olur. Sigorta hukuku açısından rücu hakkı, sigortalı ile sigortacı arasında kurulan sigorta sözleşmesi sebebiyle, rizikonun gerçekleşmesi ile meydana gelen zararın tazmini suretiyle sözleşme ile belirlenmiş olan zararın tazmini ile birlikte sigortacının zarar sorumlusuna başvurulabilmesidir. Kaynağı, sigortacının kanundan doğan halefiyetidir. Rücu ilişkisi, esas itibarıyla sigorta sözleşmesinin dışında meydana gelen bir borç ilişkisine, sözleşmenin tarafı olan sigortacının, borç ilişkisinin tarafı olan sigortalının alacak hakkına halef olması suretiyle gerçekleşmektedir. Sigorta ilişkisinin varlığı halinde ise sigortacı, sigortalının uğradığı zararı tazmin eder ve rücu hakkı gereğince zarar sorumlusuna karşı rücu davası açar. Sigorta ettiren ile sigortacı arasında kurulan sigorta sözleşmesi kapsamında ortaya çıkan uyuşmazlıklarda rücu hakkının mahkeme kararı ile hüküm altına alınabilmesi için açılan davaya rücu davası denilmektedir. Tezimizde sigorta uyuşmazlıklarında sigortacının açacağı rücu davasının hukuki niteliği, hukuki sebepleri ve öğretide tartışmalı olan hususlar, yargı kararları ışığında yargılama hukuku açısından değerlendirilmiştir.
In terms of insurance law, the insurance company pays compensation to the insured regarding a damage or loss, to this extent it replaces the insured and the insurance company has the right to sue against third parties belonging to the insured. In terms of insurance law, the right of recourse is the ability to apply to the insurer responsible for the damage, with the compensation of the damage determined by the contract, by compensating the damage caused by the realization of the risk, due to the insurance contract established between the insured and the insurer. Its source is the succession of the insurer arising from the law. The recourse relationship essentially takes place in a debt relationship that occurs outside the insurance contract, whereby the insurer, which is a party to the contract, becomes the successor to the receivables of the insured, who is a party to the debt relationship. If an insurance relationship exists, the insurer compensates the damage suffered by the insured and files a recourse lawsuit against the person responsible for the damage in accordance with the right of recourse. The lawsuit filed in order to enforce the right of recourse by a court decision in disputes arising within the scope of the insurance contract established between the policyholder and the insurer is called a recourse lawsuit. In our thesis, the legal nature of the recourse lawsuit filed by the insurer in insurance disputes, its legal reasons and controversial issues in the doctrine have been evaluated in terms of trial law in the light of judicial decisions.
