Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Çalışmamızın konusunu, miras davaları bakımından mahkemelerin milletlerarası yetkisi oluşturmaktadır. Günümüzde gelişerek kolaylaşan ulaşım, iletişim imkânları, dünyanın küreselleşmesi, göçlerin artması, farklı vatandaşlıklardan olanların evlenmesi ve benzeri gibi sebeplerle, kişilerin başka ülkelerde mal edinme, taşınmaza sahip olma, iş kurma, yatırım yapma eğilimleri artmaktadır. Bunun sonucunda, belki kişinin vatandaşlık bağı bakımından belki de terekenin birden fazla ülkeye yayılmış olmasından kaynaklı olarak, miras uyuşmazlıkları bakımından milletlerarası unsurun bulunduğu uyuşmazlık sayısı gün geçtikçe artmaktadır. Milletlerarası miras uyuşmazlıklarıyla karşılaşan ülke mahkemeleri, bu uyuşmazlığa uygulanacak hukukun araştırılmasından evvel, uyuşmazlığı esastan çözmek için milletlerarası yetkiye sahip bulunup bulunmadığını, yine kendi ülke hukukunun milletlerarası usûl kurallarına göre değerlendirecektir. Çalışmamızın birinci bölümünde incelenen, 17 Ağustos 2015'te yürürlüğe giren AB Miras Tüzüğü, Tüzüğün uygulanmasını kabul eden üye devletler bakımından uygulanmakta olan ve miras davalarında milletlerarası yetkiye ilişkin olarak da düzenlemeler içeren bir mevzuattır. Tüzükte miras davaları bakımından miras bırakana tanınan, şartlara bağlanmış hukuk seçimi imkânı gibi mirasçılara da miras bırakanın hukuk seçimi yapmış olması hâlinde yetki anlaşması yapma imkânı tanınmıştır. Çalışmamızın ikinci bölümünde ise, Türk hukuku açısından miras davalarında milletlerarası yetkiyi düzenleyen hüküm incelenmiş ve son olarak ise Miras Tüzüğünde getirilen düzenlemeler de dikkate alınarak bir değerlendirme yapılmıştır.
The subject of this thesis is the international jurisdiction of courts in terms of succession cases. Today, the tendency of people to acquire and own property, to establish business and to invest in foreign counties is increasing due to reasons such as advancing transportation and communication opportunities, globalization of the world, increasing of immigration, marriage of people with different citizenships and so on. As a result, the number of disputes with an international element in terms of succession disputes is increasing day by day, perhaps due to the individual's bond of citizenship or perhaps because of estate has spread to more than one country. The courts which are handling with an international succession dispute will evaluate whether they have the international jurisdiction for ruling the dispute from the basis, according to the international procedural rules of their own country before deciding the law to be applied to this dispute. The EU Succession Regulation is a legislation that is applied in terms of international juristiction in succession lawsuits, examined in the first part of this thesis. Regulation came into force on 17 August 2015 and from this date applied in member states that accept its implementation. Within the boundaries of this Regulation, the inheritor is given the opportunity to choose the law under certain conditions. Similarly, heirs are given the opportunity to conclude a choice-of-court agreement with certain conditions. In the second part of this thesis, the provisions of Turkish Private International Law rules which regulate international juristiction in succession cases will be examined . In the conclusion of the thesis, taking into consideration the Succession Regulation an assessment is be made.
