Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

'Cumhurbaşkanlığı kararnamesi' terimi Türk hukukuna 1982 Anayasası'nın kabul edildiği ilk şeklindeki 107'nci maddesi ile Cumhurbaşkanı'nın 'Cumhurbaşkanlığı Genel Sekreterliği'ni düzenlemesi amacıyla girmiştir. Türkiye'de 18/08/1983 tarih ve 1 sayılı ilk Cumhurbaşkanlığı kararnamesinin muhtevası da Cumhurbaşkanlığı Genel Sekreterliğini düzenleyici kapsamda olmuştur. 16/04/2017 tarih ve 6771 sayılı Kanun'la 'Cumhurbaşkanlığı hükûmet sistemi'ne geçişi sağlayan Anayasa değişiklikleri kapsamında, 1982 Anayasası'nın Cumhurbaşkanlığı Genel Sekreterliğinin düzenlenmesi amacıyla çıkarılmasını belirlediği 107'nci madde ilga edilmiştir. Cumhurbaşkanlığı kararnamesi, değişiklikle birlikte monist (tekçi) bir oluşum arz eden yürütme organının yegâne kanadını oluşturan Cumhurbaşkanı tarafından yürütme yetkisine ilişkin konularda çıkarılabilecek bir hukuk normu niteliğini kazanmıştır. Cumhurbaşkanlığı kararnamesinin düzenleme alanı ve hukuk normları arasındaki sıralama ve ilişkisini ifade eden normlar hiyerarşisindeki konumu doktrinde tartışmalı bir nitelik sergilemektedir. Bu çalışma, yürütme organının düzenleme yetkisi temelinde, Cumhurbaşkanlığı kararnamesi normunun Türk hukukundakini yerini ve normlar hiyerarşisinde diğer hukuk normlarına göre konumunu incelemeyi hedeflemektedir.
The term 'Presidential decree' appeared for the first time in Turkish law with Article 107 of the 1982 Constitution in order to regulate the 'Secretariat General of the Presidency' by the President, and the content of the first Presidential decree enacted in 1983 in Turkey was within the regulatory scope of the Secretariat General of the Presidency. Within the scope of the constitutional amendments that took place in 2017 and enabled the transition to the Presidential government system, Article 107 of the 1982 Constitution that determined the Presidential decree to be issued in order to regulate the Secretariat General of the Presidency has been abolished and the Presidential decree has become a legal norm that can be issued in matters of executive power by the President, who is the sole wing of the executive body. The regulatory area and position of the Presidential decree in the hierarchy of norms, which expresses the superior - subordinate relationship between the legal norms, has become controversial in the doctrine. Hereby, this study was conducted in an attempt to analyze the place of the Presidential decree in Turkish legal system and its position in the hierarchy of norms in comparison to other legal norms, on the basis of the regulatory power of the executive body.
