Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Nüfus kayıtları, kişilerin gerçek durumunu yansıtan, kişisel bilgilerinin yer aldığı resmî kayıtlardır. Yanlış anlaşılma, dikkatsizlik, yanılma gibi nedenlerle kişisel bilgiler, nüfus siciline yanlış kaydedilebilmektedir. Dolayısıyla bu gibi durumlarda nüfus sicilinde yazan bilgiler ile gerçek bilgiler birbirine uymamaktadır. Resmî kayıtlar, kamu düzeni nedeniyle gerçekleri yansıtmak zorundadır. Bu nedenle nüfus kaydında yer alan basit imla yanlışlıkları (maddî hata) dışındaki yanlışlıkların düzeltilmesi için nüfus kaydının düzeltilmesi talep edilecektir. Mahkeme kararı olmadıkça nüfus kaydında düzeltme yapılamaz (NHK m. 35). Nüfus kaydının düzeltilmesine ilişkin esaslar, Nüfus Hizmetleri Kanunu m. 35 - 37 arasında düzenlenmiştir. Yargılamada uygulanacak yargılama usulüne ilişkin esaslar ise, Hukuk Muhakemeleri Kanunu hükümlerine tâbidir. Kayıt düzeltme talepleri, genel anlamda, kişisel ve kamusal kayıt düzeltme talepleri olmak üzere ikili ayrıma tâbi tutulmuştur. Çalışma konumuz, Nüfus Hizmetleri Kanunu m. 35 - 37 ile Hukuk Muhakemeleri Kanunu'nda düzenlenen usulle düzeltilecek olan kişisel ve kamusal ad, doğum tarihi (yaş), doğum yeri kayıtlarında düzeltme taleplerinden oluşmaktadır.
Civil registrations are official records that reflect the real status of individuals and contain personal information. Due to misunderstanding, carelessness, and error, personal information can be incorrectly recorded in the civil registry. Therefore, in such cases, the information written in the civil registry and the actual information do not match. Official records must reflect the facts due to public order. For this reason, a lawsuit will be filed for the correction of the birth registry in order to correct the inaccuracies other than the simple spelling mistakes (mistakes of fact). Unless there is a court decision, the civil record cannot be corrected (LCRS art. 35). Principles regarding the correction of civil registration are arranged between art. 35 and 37 of the Law on the Civil Registration Services. The principles regarding the trial procedure to be applied in the case are subject to the provisions of the Code of Civil Procedure. Cases for the correction of civil registration are generally subjected to a dual distinction as personal and public register correction cases. The subject of this study is that of the case for the correction of personal and public name, date of birth (age), and birthplace records, which will be corrected by the procedure regulated in the Code of Civil Procedure and Articles 35 - 37 of the Law on the Civil Registration Services.
