Türkiye'nin uluslararası göç politikalarının uluslararası göç hukukuna uyumu ve sorunları (1923-2020)

Abstract

Uluslararası mülteci hukukunun temelini 1951 yılında imzalanan Mültecilerin Hukukî Statüsüne Dair Cenevre Sözleşmesi ve bu sözleşme çerçevesinde kabul edilen 1967 tarihli Mültecilerin Hukukî Statüsüne İlişkin Protokol oluşturmaktadır. Mülteci kavramını tanımlamakta olan 1951 Mülteci Sözleşmesi, mülteciler için koruma sağlamaktadır. Türk anayasal sisteminde kanun değeri taşıyan 1951 Mülteci Sözleşmesi ile 1967 tarihli protokol iç hukukta temel düzenlemeler şeklinde uygulanmıştır. 30 Kasım 1994 tarihinde 'Türkiye'ye İltica Eden veya Başka Bir Ülkeye İltica Etmek Üzere Türkiye'den İkamet İzni Talep Eden Münferit Yabancılar İle Topluca Sığınma Amacıyla Sınırlarımıza Gelen Yabancılar ve Olabilecek Nüfus Hareketlerine Uygulanacak Usul ve Esaslar Hakkında Yönetmelik' yürürlüğe girmiştir. Bu şekilde Avrupa kıtası haricinde Türkiye'ye yönelik gerçekleşmekte olan sığınma girişimleri karşısında ihtiyaç duyulan düzenlemeler sağlanmıştır. Özellikle Suriye'den yaşanan göçmen akınından dolayı yapılan değişiklikler sonucunda, 2013 yılında 6458 Sayılı Yabancılar ve Uluslararası Koruma Kanunu (YUKK) yürürlüğe girmiştir. Bu tez çalışmasının amacı, 1951 tarihinde imzalanan Mültecilerin Hukukî Statüsüne Dair Cenevre Sözleşmesi'nden günümüze kadar dünyada mülteci hukukuna yönelik olarak yapılmış çok sayıdaki düzenleme bağlamında, Türkiye'de mülteci hukukuna yönelik olarak yapılmış hukuki ve idari düzenlemeleri değerlendirmektir. Bu çerçevede Türkiye'de mülteci hukukuna yönelik düzenlemelerin uluslararası düzenlemelere uyumu ve ortaya çıkan sorunlar tespit edilmeye çalışılacaktır. The basis of international refugee law is the Geneva Convention on the Legal Status of Refugees signed in 1951 and the 1967 Protocol Relating to the Legal Status of Refugees, which was accepted within the framework of this convention. The 1951 Refugee Convention, which defines the concept of refugee, provides protection for refugees. The 1951 refugee convention, which has legal value in the Turkish constitutional system, and the 1967 protocol were implemented in the form of basic regulations in domestic law. On 30 November 1994, 'The Regulation on the Procedures and Principles to be Applied to Individual Foreigners Who Have Taken Asylum in Turkey or Requested a Residence Permit from Turkey to Take Asylum in another Country and Foreigners Who Came to Our Border for Collective Asylum and Possible Population Movements' came into effect. In this way, the necessary regulations have been provided in the face of asylum attempts to Turkey from outside the European continent. As a result of the changes made especially due to the influx of immigrants from Syria, the Law on Foreigners and International Protection (YUKK) No. 6458 came into force in 2013. The aim of this thesis is to evaluate the legal and administrative regulations regarding refugee law in our country, in the context of numerous regulations on refugee law in the world, from the Geneva Convention on the Legal Status of Refugees signed in 1951 to the present day. In this context, it will be tried to determine the compatibility of the regulations regarding refugee law in Turkey with international regulations and the problems that arise.
