Abstract
4721 sayılı Türk Medeni Kanununun 185. maddesi, eşler arasında kurulan geçerli bir evlilik birliği içerisinde sahip olunan hakları ve üstlenilen yükümlülükleri düzenlemektedir. Bu kapsamda evlilik birliğinin eşlere yüklediği en önemli yükümlülüklerden birisi de sadakat yükümlülüğüdür. Zina, sadakat yükümlülüğünün bir görünümü olan cinsel sadakati ihlal eden davranış niteliğinde olup, evlilik birliği devam ederken eşten başka bir kimseyle cinsel ilişki yaşanmasını ifade etmektedir. Günümüzde zina, ceza hukuku alanında suç olmaktan çıkarılmakla birlikte, medeni hukukun farklı alanlarında ayrı yaptırımlara tabi tutulmuştur. TMK'de özel ve mutlak bir boşanma sebebi olarak düzenlenen zina, ayrıca eşler yönünden tazminat ve nafaka sorumluluğuna yol açabilmektedir. Bununla birlikte kanun koyucu, mal rejiminin tasfiye edilmesine ilişkin hükümlerde zinayı dikkate alarak istisnai bir düzenleme yapma gereği duymuştur. Tüm bunların yanı sıra, koşulların oluşması hâlinde zina eyleminde bulunan kişi mirasçılıktan çıkarılma yaptırımıyla da karşılaşabilecektir.
Article 185 of the Turkish Civil Code No. 4721 regulates the rights and obligations between spouses which are undertaken in a valid conjugal union. Within this context, one of the most important obligations that appears is loyalty. Adultery is a behavior that violates sexual aspect of loyalty obligation which means that one of the spouses conducts sexual relationship with another person during the conjugal union. Nowadays, adultery is no longer a crime in terms of criminal law, however it is subject to separate sanctions in the different fields of civil law. Adultery, which is regulated as a special and an absolute ground of divorce under the Turkish Civil Code, may also lead to compensation and alimony responsibility for spouses. In addition to this, the legislator has felt the necessity to make a special regulation in the provisions concerning division of matrimonial property. Besides all of these, in the event that the conditions are fulfilled, the person who committed adultery may be subject to the sanction of being debarred from heritance.
