Abstract
Bu çalışmanın konusu oluşturan irtikap suçu, 5237 sayılı TCK'nın İkinci Kitabının 'Millete ve Devlete Karşı Suçlar' başlıklı dördüncü kısmının 'Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar' kapsamında yaptırım altına alınmıştır. İrtikap suçunun; 'Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar' bölümde düzenlenmesi nedeniyle kamu idaresi kavramı, özgü suç niteliği gereği kamu görevlisi kavramı, 'Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar' ile korunan hukuki yarar, irtikap suçunun konusu, faili, mağduru, maddi ve manevi unsurları, özel görünüş şekilleri, soruşturma ve kovuşturma usulü, görevli mahkeme ve benzer suçlarla karşılaştırması çalışmanın konusunu oluşturmaktadır. Bu çalışma iki bölümden oluşmakta olup, birinci bölümünde 'Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar' bölümü kapsamında kamu idaresi ve kamu görevlisi kavramları ile korunan hukuki yarar; ikinci bölümde ise irtikap suçunun mülga 765 sayılı TCK ve 5237 sayılı TCK çerçevesinde düzenlenişi, suç ile korunan hukuki yarar, suçun konusu, faili, mağduru, maddi ve manevi unsurları, özel görünüş şekilleri, soruşturma ve kovuşturma usulü, görevli mahkeme ve benzer suçlarla karşılaştırması yargı kararları ve doktrin çerçevesinde incelemeye alınmıştır. The crime of extortion, which is the subject of this study, is punished as per 'Crimes against the Reliability and Functioning of the Public Administration' of the fourth section titled 'Crimes against the Nation and the State' of the Second Book of the Turkish Criminal Code numbered 5237. Since the crime of extortion is regulated in the section titled 'Crimes Against the Reliability and Functioning of Public Administration', the concept of public administration, the concept of public official due to its specific criminal nature, the legal benefit protected by 'Crimes Against the Reliability and Functioning of Public Administration', the subject of the crime, perpetrator, victim, material and moral elements, special forms of crime appearance, investigation and prosecution procedure, competent court, and comparison with similar crimes constitute the subject of the study. This study consists of two parts. The first part examines the concepts of public administration, public official, and the legal benefit protected within the scope of the section 'Crimes against the Reliability and Functioning of Public Administration'. The second part assesses the regulation of the crime of extortion within the framework of the abrogated the Turkish Criminal Code numbered 765 and the Turkish Criminal Code numbered 5237, the legal benefit protected by the crime, the subject of the crime, perpetrator, victim, material and moral elements, special forms of crime appearance, investigation and prosecution procedure, competent court, while comparing the crime of extortion with other similar crimes. To this end, this study also includes judicial decisions and doctrinal discussions in each part. Keywords: extortion, public administration, public official, duress, persuasion, defense of mistake.
