Europeanization of Turkish Judicial System After 1999

Abstract

Türkiye Cumhuriyeti'nin, Avrupa Birliği ile ilişkisi 20. yüzyılın ortalarında tam üyelik hedefi ile başlamış ve halen aynı hedef doğrultusunda devam etmektedir. Bu süreç Türk tarafının bir çok alanda dönüşüm ve değişimine neden olmuştur. Türk yargı sistemi de bu dönüşüm ve değişimden epeyce etkilenmiş, özellikle 1999 Helsinki Zirvesi sonrasında Türk yargı sisteminde çok derin ve köklü reformlar gerçekleştirilmiştir. Bu tezde 1999 Helsinki Zirvesi sonrası dönemden itibaren günümüze kadar olan süreçte Türk yargı sisteminde mevzuat ve yapısal olarak gerçekleştirilen reformlar ele alınmış, ayrıca Avrupa Birliği dışında reformları etkileyen faktörler tespit edilmeye çalışılmıştır.The relationship between the Republic of Turkey and the European Union started in the middle of 20th century and still continues to be in line with the same target. This process has caused transformation and change in many fields of Turkish side. Turkish judicial system has been also influenced by this transformation and change quite a bit, especially after the 1999 Helsinki Summit, very deep and drastic reforms were carried out in the Turkish judicial system. In this thesis, after the Helsinki Summit of 1999, the reforms, which were carried out as legislation and structural,has been handled, also the factors, affecting the reforms that outside the European Union were tried to determine.
