Effects of State Succession on Nationality in the Context of Land Abondenment and Annexation

Abstract

Savaşlar veya anlaşmalar gibi farklı yollar ile bir devletin hakimiyet kurduğu toprak parçası üzerinde sahip olduğu egemenliğin çeşitli şekillerle değişmesi mümkündür. Uluslararası hukukta devletlerin halefiyeti olarak ifade edilen bu durumun farklı hukuksal sonuçları bulunmaktadır. Bu sonuçlardan bir tanesi de o toprak parçası ile farklı nedenlerle ilgisi bulunan kişilerin tabiiyetleri üzerindeki değişim olmaktadır. Bu değişimin kimler üzerinde etkisinin olacağı ve ardından bu değişimin nasıl gerçekleşeceği konusu önem taşımaktadır. Arazi terk ve ilhakı, bir devlete ait toprağın bütününün ya da bir parçasının üzerindeki egemenliğin bir başka devlete geçmesidir. Toprak parçası üzerindeki egemenliğin değişmesi sonucu yapılan anlaşmaların pek çoğunda o toprak parçasıyla ilgili kimselere bir seçme hakkı (right to option) tanındığı görülmektedir. Çalışma kapsamında, öncelikle devletlerin halefiyeti ve uluslararası hukuk perspektifinden tabiiyet konusu incelendikten sonra devletlerin halefiyetinin tabiiyet üzerindeki etkileri arazi terk ve ilhakı bağlamında incelenecektir.

By different means, such as wars or treaties, it is possible that the sovereignty of a state over the piece of land it dominates can be changed in various ways. This situation, which is expressed as the state succession in international law, has different legal consequences. One of these consequences is a change in the nature of the people who have something to do with that piece of land for different reasons. It is important to whom this change will have an impact and then how this change will take place. Land abandonment and annexation is the transfer of sovereignty over the whole or part of a state-owned land to another state. In many of the agreements concluded as a result of the change of sovereignty over the piece of land, it is seen that a right of choice (right to option) is granted to those concerned with that piece of land. Within the scope of the study, the succession of the states and the effects of the succession of the states on the nature will be examined in the context of land abandonment and annexation.
