Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Çalışmamızın konusu 6769 Sayılı Sınai Mülkiyet Kanunu kapsamında elektronik ticarette marka hakkına tecavüz ve markanın korunmasıdır. Ticari faaliyetlerde elektronik aletlerin kullanılması ile beraber elektronik ticaret kavramı ortaya çıkmış, geleneksel ticarette bir dijital dönüşüm başlamıştır. Elektronik ticaret, çevrimiçi olarak gerçekleştirilen; mal veya hizmetlerin üretimi, alımı, satımı, reklamı, pazarlanması gibi her türlü ticari faaliyet olarak tanımlanabilir. Marka, bir teşebbüse ait ürün veya hizmetlerin diğer teşebbüslerinkinden ayrılmasını sağlayan işaret olup kaynak gösterme, ayırt edicilik, reklam ve iletişim, garanti ve kalite gibi fonksiyonları ile değeri teşebbüsleri aşan ayrı bir ekonomik değer haline gelmiştir. Markaların ekonomik değeri ve fonksiyonları kullananlara rakipleri karşısında çeşitli avantajlar sağlamaktadır. Bu nedenle, üçüncü kişiler markanın sağladığı avantajlardan yararlanmak için 6749 Sayılı Sınai Mülkiyet Kanunu'nda tecavüz olarak adlandırılan şekilde başkalarına ait markaları sıklıkla kullanmaktadır. Bu çalışmada elektronik ticaret faaliyetlerinde gerçekleşen marka hakkına tecavüz hallerinin 6769 Sayılı Sınai Mülkiyet Kanunu kapsamında değerlendirilmesi amaçlanmıştır. Çalışma üç bölümden oluşmaktadır. Çalışmanın birinci bölümünde konuya ilişkin temel kavramlar olan elektronik ticaret kavramı ve marka kavramı açıklanmış, ikinci bölümünde marka hakkına tecavüz halleri elektronik ticaret kapsamında değerlendirilmiştir. Çalışmanın üçüncü bölümünde ise tecavüz halinde hukuken yapılabilecekler, konu ile ilgili önemli sorumluluk halleri ve hak ihlali halinde açılabilecek hukuk davaları açıklanmıştır.
The subject of our study is Infringement of Trademark Rights and Protection of Trademarks in Electronic Commerce within the scope of Industrial Property Law No. 6769. With the use of electronic tools in commercial activities, the concept of electronic commerce has emerged. Electronic commerce, can be defined as any kind of commercial activity such as the production, purchase, sale, advertisement, marketing of goods or services which are carried out online. The trademark is a sign that distinguishes the products or services of a business organisations from the products or services of other business organisations. The trademark has become a separate economic value that exceeds business organisations with the functions of showing origin, distinctiveness, advertising and communication, guarantee and quality etc. The economic values and functions of trademarks provide business organisations with various advantages over their competitors. In order to benefit from these advantages, illegal use of trademarks is frequently encountered. These uses are called trademark violation in the Industrial Property Law No. 6749. In this study, it is aimed to evaluate the situations of trademark infringement in electronic commerce activities within the scope of the Industrial Property Law No. 6769. The study consists of three parts. In the first part of the study, the concept of electronic commerce and the concept of brand, which are the basic concepts related to the subject, are explained. In the second part, infringement of trademark rights is evaluated within the scope of electronic commerce. In the third part of the study, defenses that can be put forward in situation of infringement and important liability situations related to the subject are explained.
