Kamuda Seferberlik ve Savaş Hali Hazırlıkları (türk Silahlı Kuvvetleri Personel Seferberlik Sistemi ve Erbaş ve Er Seferberolma Faaliyetleri)

Abstract

Seferberlik, devletin tüm güç ve kaynaklarının; savaşın ihtiyaçlarını karşılayacak şekilde hazırlanması ve kullanılmasına ilişkin faaliyetlerin uygulandığı ve kanunlarla vatandaşların hak ve özgürlüklerine geçici olarak bir takım sınırlamalar getirildiği durumdur. Seferberlik faaliyetleri sadece silahlı kuvvetleri ilgilendirmemekte, devletin sivil kurumları ile tüm halkı yakından ilgilendirmektedir. Bu nedenle seferberlik sisteminin amaçladığı hedeflere ulaşabilmesi, konu hakkında, halkın bilinçlenmesine ve tüm yönetim örgütünün üzerine düşen görevleri tam olarak yerine getirmesine bağlıdır.Bu çalışma; Kamuda Seferberlik ve Savaş Hali Hazırlıklarının (TSK Personel Seferberlik Sistemi ve Erbaş Er Seferber Olma Faaliyetleri) incelenmesini, konuyla ilgili mevzuatın ortaya konarak vatandaşların seferberlik ve savaş haline ilişkin mevzuat, uygulama ve teorik alanlardaki bilgi düzeylerinin tespit edilmesini amaçlamaktadır.İlk bölümde seferberliğin tarihsel sürecinden örnekler ve seferberlik hakkındaki genel bilgiler ile tezin kapsamı, önemi, amacı, yöntemi ve soruları yer almaktadır. İkinci bölümde idare hukukundaki olağanüstü yönetim usulleri incelenmiş ve seferberliğin bu açıdan değerlendirmesi yapılmıştır. Üçüncü bölümde kamuda seferberlik ve savaş hali hazırlıkları açıklanmaya çalışılmış ve bu kapsamda ilgili kurumların görev ve sorumlulukları anlatılmıştır. Dördüncü bölümde Türk Silahlı Kuvvetleri Personel Seferberlik Sistemi açıklanmış ve Asteğmen, Çavuş, Onbaşı ve Er rütbesindeki personelin seferberlik hazırlıkları incelenmiştir. Beşinci bölümde terhis olarak yedek statüsüne geçmiş personelde seferberlik konusundaki bilgi düzeyinin tespit edilmesi maksadıyla yapılan anket çalışmasının bulgularına yer verilmiş ve son olarak altıncı bölümde bu anket sonucunda ortaya çıkan analizler ile tezin teorik kısmındaki bilgiler birleştirilerek değerlendirme ve önerilerde bulunulmuştur.Araştırma kapsamında seferberlik konusundaki bilgi düzeyinin tespit edilmesi maksadıyla 10 sorudan oluşan ankete verilen cevapların değerlendirilmesi sonucunda, bu konudaki bilgi düzeyinin düşük seviyede olduğu saptanmıştır.Bu da ülkemizde konuyla ilgili kurum ve kuruluşlar tarafından kamuoyuna yeterli bilgilendirme yapılmadığı gerçeğini ortaya koymuştur.Anahtar Kelimeler:Seferberlik,Olağanüstü Yönetim Usulleri,TSK Personel Seferberlik Sistemi.Mobilization is the case when the activities for preparation and use of all forces and sources of the government in a manner to meet all requirements of war are applied and the rights and freedoms of citizens are temporarily subjected to some restrictions. Mobilization activities are not only for armed forces but also for civil entities of the government and all people closely. For that reason, achievement of targets aimed by the mobilization system depends on making the people conscious about the matter and fulfillment of all required duties by all government organization.This study aims to examine the Preparations for Mobilization and War in Public (Mobilization System and Privates and Petty Officers Mobilization Activities in Turkish Armed Forces), to study the regulation about the matter and determine the knowledge level of citizens about mobilization and war case in practice and theoretical aspects.In part one, the historical background of mobilization has been studied by means of examples and general information about mobilization and also scope, importance, purpose, method and questions of the thesis have been stated. Part two contains examination of extraordinary government procedures in public law and the assessment of mobilization in this respect. Part three explains mobilization and war case preparations in public and the duties and responsibilities of related entities have been explained in this respect. Part four explains Personnel Mobilization System of Turkish Armed Forces and mobilization preparations of personnel having the rank of second-lieutenant, sergeant, corporal and privates have been studied. Part five gives findings of questionnaire given to personnel discharged and listed as standby to find out knowledge level of them about mobilization and finally part six contains the analysis of the questionnaire and assessment of the data collected in the theoretical part of the thesis and the recommendations.As a result of assessment of the answers given to 10 questions aiming to find out the knowledge level in mobilization studied under the study, it has been found out that the knowledge level in this matter is low, which reveals the fact that the related entities and organizations have not made adequate activities to make public consciousness about the matter in our country.Key Words: Mobilization, Extraordinary Government Procedures, Turkish Armed Forces Personnel Mobilization System.
