Bu hüküm sadece malzeme sağlama bakımından borçları ilgilendirmektedir. Oysa ki, TBK m. 473/II'deki işe başlama ve yürütme, TBK m. 483'teki eserin yok olması, TBK m. 474 ve devamındaki ayıp sebebiyle sorumluluk başlıklı maddeler de malzeme nedeniyle sorumlulukları ilgilendirmektedir. İncelememizde eser meydana gelmeden önce, eser meydana getirilirken ve eser teslim edildikten sonraki malzeme nedeniyle sorumluluk başlıkları açılarak ayrı ayrı değerlendirilmeye çalışılacaktır. Bu sorumluluklar nihayetinde sadakat borcunun sonucu olduğundan özen ve bildirim yükümlülükleri kavramları ile bildirme külfetleri kavramlarına da yer verilecektir. Çalışmamızın daha iyi anlaşılması için tüketici ve kamu hukuku ile FIDIC'e göre malzeme nedeniyle sorumluluk hâllerine kısaca değinilecektir.Our work titled 'Contractor's Liability for Materials in the Contract of Works' is broader than Article 472 of the Turkish Code of Obligations.
