Beyin Ölümü Gerçekleşen Gebe Kadında Gebeliğin Sona Erdirilmesine İlişkin Bir Değerlendirme

Abstract

Ölüm yaşamı sona erdiren biyolojik bir olgu olmanın yanında, hukuki bir olaydır. Bu hukuki olayın ne zaman gerçekleştiğinin tespit edilmesi ise, çözülmesi gereken ilk sorundur. Ancak bunun tespiti tıp biliminin işidir. Tıp biliminde ise, bugünkü teknolojiler ile gelinen noktada ölüm anının tespiti için beyin ölümünün gerçekleşmesi aranmaktadır. Beyin ölümü, beyindeki tüm fonksiyonların geri dönüşü olmaksızın durmasıdır. Dolayısıyla kişi bu andan itibaren tıbben ölü kabul edilmekte ve organ nakli prosedürleri işletilebilmektedir. Oysa son teknolojik gelişmeler sayesinde kadının beyin ölümü gerçekleşmesine rağmen, belirli sürenin üzerindeki gebeliklerde ceninin sağlıklı bir şekilde doğması sağlanabilmektedir. Bu halde ise, beyin ölümü gerçekleşen gebe kadının ölüm anının nasıl tespit edileceği ve gebeliğin akıbeti sorgulanabilir hale gelmektedir.Death is not only a biological phenomenon that ends life, but also a legal event. Determining when this legal event occurs is the first problem to be solved. However, the determination of this is a matter for medical science. In medical science, at the point reached with today’s technologies, brain death is required to determine the moment of death. Brain death is the irreversible cessation of all functions in the brain. Therefore, from this moment on, the person is considered medically dead and organ transplan- tation procedures can be carried out. However, thanks to recent technolo- gical developments, it is possible to ensure that the fetus is born healthy in pregnancies over a certain period of time, despite the woman’s brain death. In this case, it becomes questionable how to determine the moment of death of a pregnant woman with brain death and the fate of the pregnancy.
