Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Marka, 6769 sayılı Sınai Mülkiyet Kanunu kapsamında kural olarak aynı veya benzer mal veya hizmetler yönünden korunmaktadır. SMK md.6.5'te markanın Türkiye'de ulaştığı tanınmışlık düzeyi nedeniyle ayırt edici karakterinin zedelenebileceği, itibarının zarar görebileceği veya markadan haksız yarar sağlanabileceği hallerde, tanınmış markayla aynı veya benzer marka için yapılmış başvurunun, haklı bir sebebe dayanma hali saklı kalmak üzere, aynı, benzer veya farklı mal veya hizmetlerde yapılmış olmasına bakılmaksızın reddedileceği düzenlenmektedir. Tanınmış markaya tanınan bu koruma, SMK md.7.2.c'de bir ihlal hali olarak düzenlenmektedir. Çalışmamızın birinci bölümünde, markanın Türkiye'de tanınmışlık düzeyine ulaşması incelenmiştir. Çalışmamızın ikinci bölümünde ise tanınmışlık düzeyine ulaşmış markanın sulandırılması sebebiyle korunması incelenmiştir. Tanınmış markanın sulandırılması halleri, uluslararası hukuk, ABD, AB ve Türk hukuklarındaki düzenlemeler yönünden değerlendirilmiştir.
According to Industrial Property Law No. 6769, a trademark is protected in terms of the same or similar goods or services. However, unlike the ground rules article 6.5 of the Industrial Property Law states that, a trademark application which is identical with, or similar to, an earlier registered trademark or application irrespective of whether the goods or services for which it is applied or registered are identical with, similar to or not similar to those for which the latter trademark is applied for, and the use of the latter trademark without due cause would take unfair advantage of, or be detrimental to the distinctive character or the repute of the earlier trade mark due to the reputation the earlier trademark has in Turkey; shall be refused upon opposition of the proprietor of that earlier trademark. This protection granted to a well-known trademark is regulated as a violation in article 7.2.(c) of the Industrial Property Law. In the first part of our study, the status of a trademark reaching the level of recognition in Turkey was examined. In the second part of our study, the protection of a trademark, which has reached the level of recognition, due to dilution has been examined. The cases of dilution of a well-known trademark have been evaluated in terms of regulations in international law, USA, EU and Turkish law.
