Started in 2003 with 21 students, the Atılım University School of Law has so far graduated over 1700 students, and currently offers education for more than 1300 students. With the aim stressed by our Founding Dean Prof. Dr. Nami Çağan, we grant students with the background that allows them to access and evaluate information, rather than overloading them with information dumps during our education and training in the field of law. With a curriculum prepared with this approach and our mission in mind, we aim to graduate our students as actual legal experts who have internalized ethical rules, who are knowledgeable in terms of rules and institutions; and who are cultured, versatile, broad-visioned and inquisitive. In addition to basic courses in law conducted by our academic staff as pioneers of their field with respect to these principles, elective courses are available pursuant to current events such as those in mediation for legal disagreements, law and women, sports law, informatics law, media law and legal English; as well as law clinics to offer effective and interactive education. In addition, graduate and doctorate degree programs, alongside certificate programs such as those to train experts, peace-makers, mediators, and trustees in composition, are underway. A member of the European Law Faculties Association (ELFA), our School offers international relations and events, the Erasmus+ program, national and international fictional court contests, law and art days prepared by our student networks, or career forums in law to collaborate in the personal development of our students.

Abstract

Geçici ödeme, 1 Temmuz 2012 tarihinde yürürlüğe giren Türk Borçlar Kanunu’muz ile hukuk sistemimizde kabul edilen yeni bir kavramdır. TBK md.76’da düzenlenen geçici ödemenin amacı, uzun süren yargılamalar neticesinde, davacının mağduriyetinin önlenmesi olup, yargılama sonucunda hükmedilmesi muhtemel olan tazminatın bir kısmının önceden ödenmesidir. Zarar göre davacı, iddiasının haklılı ğını gösteren inandırıcı kanıtlara mahkemeye sunar, ekonomik duru mu da geçici ödemeyi gerektirirse, talebinin varlığı halinde, mahke mece geçici ödemeye hükmedilebilir. Madde gerekçesinde “uğradığı zararın giderilmesi için acilen parasal desteğe ihtiyaç duyan” davacıdan bahsedilmektedir. Acil parasal desteğin, ancak maddi zararların tazmini için açılan maddi tazminat davalarında söz konusu olabileceğini söylemek, dolayısıyla, gerekçeden yola çıkarak, manevi zararlardan dolayı, geçici ödemeye hükmedilmesine yer olmadığı yorumunu yapmak mümkündür. Çalışmada, geçici ödemenin amacı, koşulları, benzer kavramlar dan farkları, uygulama alanı ile hüküm ve sonuçları ele alınacaktır.

ABSTRACT: Transitional payment is a new accepted notion in Tur kish Code of Obligations, which is inured in 1.7.2012. That notion was not held in place in old Code of Obligations number 818. The aim of transitional payment which is found in Article 76 in Turkish Code of Obligations, is to help people who had loss by a tort or the transverse of the contract. That help must be made by, paying some amount of money with no need to wait for the final court decision. If the person who had a damage asks the judge for transitional payment and damage can be shown tothe court by be lievable proofs, and the economic situaiton of the damaged person is necessitate for that payment, the judge can decide an early pay ment called transition payment. The legal basis of Article 76 says that “to avoid the damage, there must be an immediate money support” for the transitional payment. Immediate support can only be possible in material da mages. In this study, we will discuss the aim and the conditions of transitional payments, the differences with the similar notions, and the application area of transitional payments.
