Abstract

In administrative jurisdiction, the time limit for filing an action is not merely a technical procedural rule; rather, it constitutes a determining element of the right of access to a court, which ensures judicial review of the lawfulness of administrative acts and actions. The right of access to a court, in turn, is an essential component of the freedom to seek legal remedies and the right to a fair trial, both safeguarded by Article 6 of the European Convention on Human Rights, to which Turkey is a party, and Article 36 of the Constitution. The time limit for bringing an action simultaneously fulfils two distinct functions: on the one hand, it restricts the right of individuals adversely affected by administrative actions and transactions to access the courts within a certain period; on the other hand, it prevents administrative acts and actions from being perpetually exposed to the threat of litigation. Put differently, the time limit for filing an action must strike a balance between the right of access to a court and legal certainty—an indispensable requirement of the rule of law. Establishing this balance primarily falls within the competence of the legislative branch. However, the discretion afforded to the legislature in this regard is neither absolute nor unlimited; it must comply with the standards established by the case-law of the European Court of Human Rights and Article 13 of the Constitution, refrain from interfering with the very essence of the right of access to a court, and avoid regulations that may result in disproportionate restrictions under the pretext of maintaining legal certainty. Furthermore, in order to ensure that the right of access to a court remains practicable and that administrative acts and actions are subject to effective judicial scrutiny, it is essential that the rules governing time limits for bringing an action are not interpreted rigidly by administrative courts. This study examines the relationship between the time limit for filing an action and the right of access to a court, which is inherent to the freedom to seek legal remedies and the right to a fair trial. Within this framework, ambiguities arising in the application of procedural time-limit rules have been identified. It has been observed that judicial practice occasionally conflicts with the essence and purpose of the right of access to a court and that this inconsistency at times stems not from the inadequacy of the rules themselves, but from their overly strict interpretation. In particular, the divergent academic views on the effect of administrative applications filed within the scope of the constitutional right to petition under Article 74 on the litigation time limit have been examined, and the uncertainties in practice have been analysed in light of ECtHR and Constitutional Court jurisprudence. Recommendations have been proposed for resolving these ambiguities.
İdari yargıda dava açma süresi, yalnızca usule ilişkin bir teknik düzenleme olmanın ötesinde, idarenin yapmış olduğu eylem ve işlemlerin hukuka uygunluk yönünden denetlenmesini de sağlayan mahkemeye erişim hakkının belirleyici bir unsurudur. Mahkemeye erişim hakkı ise, gerek Türkiye'nin tarafı olduğu Avrupa İnsan Hakları Sözleşmesi'nin 6'ncı ve gerekse Anayasa'nın 36'ncı maddesi ile güvence altına alınmış olan hak arama özgürlüğü ve adil yargılanma hakkının bir gereğidir. Dava açma süresinin; bir yönüyle idarenin yapmış olduğu işlem ve eylemlerden olumsuz yönde etkilenen bireylerin mahkemeye erişim hakkını belli bir süreyle sınırlayan, diğer yönüyle de idari işlem ve eylemlerin sürekli olarak dava tehdidi altında kalmasını önleyen bir işlevi vardır. Bir başka anlatımla; dava açma süresi, mahkemeye erişim hakkı ile hukuku devleti ilkesinin bir gereği olan hukukî istikrar arasında bir denge sağlamalıdır. Bu dengeyi tesis etmek ise en başta yasama organının görevidir. Yasama organının bu görevi yerine getirirken sahip olduğu takdir yetkisi mutlak ve sınırsız olmayıp, gerek Avrupa İnsan Hakları Mahkemesi içtihatlarında ve gerekse Anayasa'nın 13'üncü maddesinde belirlenen ölçütlere uygun davranmak; mahkemeye erişim hakkının özüne dokunmamak ve hukukî istikrarı tesis etme uğruna mahkemeye erişim hakkına ölçüsüz bir müdahalelere yol açabilecek düzenlemelerden kaçınmak zorundadır. Öte yandan, gerek mahkemeye erişim hakkının kullanılamaz hale gelmemesi ve gerekse idarî işlemler ve eylemler üzerinde etkili bir yargısal denetimin yapılabilmesi için, yasa koyucu tarafından dava açma süresine ilişkin olarak getirilen kuralların idarî yargı yerlerince katı bir biçimde yorumlanmaması da önem taşımaktadır. Bu çalışmada, dava açma süresinin hak arama özgürlüğü ve adil yargılanma hakkının bir gereği olan mahkemeye erişim hakkı ile olan ilişkisi değerlendirilmiştir. Bu bağlamda, uygulamada süreye ilişkin kuralların uygulanmasındaki belirsizlikler de tespit edilmiştir. Uygulamanın zaman zaman mahkemeye erişim hakkının anlam ve özüyle çeliştiği gözlemlenmiş, bu çelişkinin zaman zaman dava açma süresine ilişkin kuralların yetersiz olmasından ziyade katı bir biçimde yorumlanmasından kaynaklandığı da gözlemlenmiştir. Özellikle; Anayasa'nın 74'üncü maddesinde güvence altına alınmış olan dilekçe hakkı kapsamında yapılan idarî başvurularının dava açma süresi üzerine etkisi konusunda öğretide ortaya konulan görüşler irdelenmiş, uygulamadaki belirsizlikler AİHM ve Anayasa Mahkemesi içtihatları ışığında değerlendirilmiş, bu belirsizliklerin giderilmesine yönelik öneriler getirilmiştir.
