Abstract
6102 Sayılı Türk Ticaret Kanunu'nun 1061/2. maddesinde düzenlenen gemi işletme müteahhidi, başkasına ait bir gemiyi kendi hesabına suda işleten kişi olarak tanımlanmaktadır. Gemi işletme müteahhidi, ilgili hükme göre, üçüncü kişilere karşı donatan sayılacaktır. Çalışmamızda gemi işletme müteahhidi Türk hukuku açısından ele alınmış, diğer ülkelere ait hukuki düzenlemeler ise çalışmamız kapsamı dışında bırakılmıştır. Üç bölümden oluşan tezimizin ilk bölümünü gemi işletme müteahhidine ilişkin temel bilgiler, ikinci bölümünü gemi işletme müteahhidinin tarafı olduğu hukuki ilişkiler, üçüncü bölümünü ise gemi işletme müteahhidinin hukuki sorumluluğu oluşturmaktadır. Çalışmada gemi işletme müteahhidinin sorumluluğu yalnızca hukuki sorumluluk bakımından incelenmiş; cezai ve idari sorumluluk çalışmamızın kapsamı dışında bırakılmıştır
Article 1061/2 of the Turkish Commercial Code No. 6102 defines a ship management contractor as a person who operates a ship belonging to another person on the water on his own account. According to the relevant provision, the ship management contractor shall be deemed as the shipowner against third parties. In our study, the ship management contractor is examined in terms of Turkish law, and the legal regulations of other countries are excluded from the scope of our study. The first part of our thesis, which consists of three chapters, is composed of basic information about the ship management contractor, the second part is composed of the legal relations to which the ship management contractor is a party, and the third part is composed of the legal liability of the ship management contractor. In the study, the liability of the ship management contractor is analyzed only in terms of civil liability; criminal and administrative liability are excluded from the scope of our study.
